Customaly respects the intellectual property rights of others and expects everyone who uses this store to do the same. We respond to clear notices of alleged copyright infringement under the United States Digital Millennium Copyright Act (the “DMCA”), 17 U.S.C. § 512.
Reporting infringing content
If you believe that material on customaly.com infringes a copyright you own or control, send a written notice to our designated agent at support@customaly.com with the subject line DMCA Notice. Your notice must include all of the following:
- Your full name, mailing address, telephone number and email address, together with your physical or electronic signature.
- A description of the copyrighted work you claim has been infringed.
- The exact URL of every page on our site where the material appears, so that we can locate it.
- Evidence that you own or control the rights in the work — for example a registration number, or the original listing where you first published it.
- A statement that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner’s behalf.
Incomplete notices will delay our response. Please note that under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing may be liable for damages, including costs and legal fees.
What happens after we receive a notice
We aim to acknowledge every complete notice within 3 business days. Where the claim is valid we will remove or disable access to the material, notify the person who posted it, and forward them a copy of your notice — including your contact details — so that they are able to respond.
Filing a counter-notice
If your content was removed and you believe the removal was the result of a mistake or a misidentification, you may send a counter-notice to support@customaly.com. The counter-notice must contain all of the following:
- Your full name, mailing address, telephone number and email address, together with your physical or electronic signature.
- Identification of the material that was removed, and the location at which it appeared before it was removed.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of a mistake or a misidentification.
- Your consent to the jurisdiction of the federal district court for the judicial district in which you live, or — if you live outside the United States — for any judicial district in which Customaly may be found, and your agreement to accept service of process from the party who filed the original notice.
We will forward your counter-notice to the original complainant. If they do not file a court action seeking to restrain the disputed activity within 10 business days, we may restore the removed material.
Repeat infringers
We terminate the accounts of users who are the subject of repeated valid infringement notices, and we may remove content or ban offenders from commenting on the site at any time.
Trademarks and other rights
The DMCA covers copyright only. If your complaint concerns a trademark, a right of publicity, or a design right, write to the same address with the details of your registration and the URLs concerned, and we will review it under the applicable law.
